1. Acceptance of Terms

By accessing or using KinkAcademy.com (the “Site”) or any content, products, or services offered through it (collectively, the “Services”), you (“you,” “User”) agree to be bound by these Terms of Service and our Privacy Policy (together, the “Agreement”). If you do not accept every part of the Agreement, do not use the Site.

2. Eligibility & Age Verification

  1. 18+ Only. The Services contain explicit sexual-education material intended solely for consenting adults 18 years of age or older (or the age of majority in your jurisdiction, if higher). By entering the Site, you represent and warrant that you meet this age requirement.

3. Educational Purpose / No Professional Advice

Content on the Site is provided for educational and entertainment purposes only and is not medical, psychological, legal, or professional advice. Always seek advice from a qualified professional before acting on information obtained here. You assume all risk arising from your use of the content, including any physical, emotional, or legal consequences.

4. Accounts & Security

  1. Registration. To access certain features, you must create an account, provide accurate information, and keep it updated.
  2. Confidential Credentials. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
  3. Single-User License. Accounts are for individual use only. Sharing login credentials or streaming content to non-members is prohibited and may result in immediate termination without refund.

5. Subscriptions, Billing & Refunds

  1. Automatic Renewal. Paid memberships renew automatically at the end of each billing cycle unless you cancel before the renewal date.
  2. Billing Authorization. You authorize Kink Academy (or its payment processor) to charge all applicable fees and taxes to the payment method you specify.
  3. Cancellation. You may cancel anytime via the “My Account” page; access remains active until the end of the paid period.
  4. Refunds. All sales are final unless we materially fail to provide the Services. Chargebacks initiated without first giving us an opportunity to resolve the issue may lead to account suspension.

6. Intellectual Property

  1. Site Content. All videos, text, graphics, trademarks, and other materials (“Content”) are owned by or licensed to Kink Academy and are protected by U.S. and international IP laws.
  2. Limited License. We grant you a personal, non-transferable, non-exclusive, revocable license to stream Content for private, non-commercial use. Any download, reproduction, redistribution, public performance, or derivative use is prohibited unless we give prior written consent.
  3. User-Generated Content. If you post, upload, or transmit any material (e.g., forum posts, reviews), you grant Kink Academy a worldwide, perpetual, royalty-free license to use, display, and distribute that material in connection with the Services. You represent that you have all rights necessary to grant this license.

7. Community Standards & Prohibited Conduct

You agree NOT to:

  • Upload, share, or solicit any content involving minors, non-consensual acts, or other illegal material.
  • Harass, abuse, or threaten other users, educators, or staff.
  • Use the Site for any commercial purpose without our written approval.
  • Attempt to reverse-engineer, hack, or disrupt the Site or servers.
  • Impersonate someone else or misrepresent your affiliation with any person or entity.

Violation may lead to immediate account termination and potential legal action.

Kink Academy collaborates with independent educators. Their opinions are their own and do not necessarily reflect our views. We are not liable for any act or omission of a third-party educator, nor for content on external sites linked from the Services.

9. Modification, Suspension & Termination

We reserve the right to modify or discontinue any part of the Services at any time, temporarily or permanently, with or without notice. We may suspend or terminate your access for any violation of this Agreement or for any reason in our sole discretion.

10. Disclaimers & Limitation of Liability

  1. “As-Is” Basis. The Services are provided “as is” and “as available,” without warranties of any kind, express or implied.
  2. No Liability for Damages. To the fullest extent permitted by law, Kink Academy, its owners, employees, or agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Services.
  3. Cap on Damages. In no event will our cumulative liability exceed the amount you paid to Kink Academy in the 12 months preceding the event giving rise to the claim.

11. Indemnification

You agree to defend, indemnify, and hold harmless Kink Academy, its affiliates, and their respective directors, officers, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt (including attorneys’ fees) arising out of (a) your use of the Services, (b) your violation of any term of this Agreement, or (c) your violation of any third-party right.

We respect copyright law and respond to DMCA notices. If you believe your copyrighted work has been used on the Site in a way that constitutes infringement, please email support@kinkacademy.com with the information required by 17 U.S.C. § 512(c)(3).

13. Governing Law & Dispute Resolution

  1. Governing Law. This Agreement is governed by the laws of the State of California, without regard to conflict-of-law principles.
  2. Informal Resolution. Before filing a claim, you agree to contact us at support@kinkacademy.com and attempt to resolve the dispute informally for at least 30 days.
  3. Arbitration & Class-Action Waiver. Any dispute not resolved informally shall be settled by binding arbitration under the American Arbitration Association rules in San Jose, California. You and Kink Academy waive any right to participate in a class action or class-wide arbitration.

14. Changes to These Terms

We may amend these Terms at any time. The revised version will be posted on this page with an updated “Last Updated” date. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
