Attorney Aimee Bouchard considers several legal issues with BDSM play in this 5-minute video. She discusses assault and battery laws and describes a relevant court case. Aimee also highlights state (and federal) laws – especially in Massachusetts – regarding play spaces, weapons, and transportation across state lines. A sobering yet critically important video for anyone interested in alternative sexuality.

The state of current laws governing adult sexuality can be scary, unfortunately we have to fight for our right to engage in consensual kinky activities. This is a huge part of why KinkAcademy.com exists, to bring more safety & awareness about these issues into the light!
I contacted my attorney the other day, and they are saying in Minnesota that if you have a signed statement of consent that it’s treated like s prize fighter contract. However, she did make a rather interesting point, you need to have a clause releasing you from any injuries they may sustain.
Super informative video. Thanks KA!
This reminded me of this quote from Gravity’s Rainbow– “Why will the Structure allow every other kind of sexual behavior but that one? Because submission and dominance are resources it needs for its very survival. They cannot be wasted in private sex. …It needs our submission so that it may remain in power…. if S and M could be established universally, at the family level, the State would wither away. This is Sado-anarchism.”
I think the author is joking, of course, but it’s something to meditate over. The petty tyrannies of everyday life can turn into bigger tyrannies.
